PREAMBLE

These Terms of Service (the "Agreement") constitute a legally binding agreement between:

1. GENERAL PROVISIONS

1.1 Acceptance of Terms
- You are at least 18 years of age
- You have full legal capacity to enter into this Agreement
- You have read, understood, and agree to comply with all terms
- If acting on behalf of an organization, you have the authority to bind it to this Agreement

1.2 Modifications
- We may modify these terms with 30 days' notice
- Notifications will be sent via email and/or posted in your dashboard
- Continued use after changes take effect constitutes acceptance
- The current version is always available at artregplatform.com/terms

2. ACCOUNT TYPES AND ROLES

Individual Accounts:
- Author: manage artworks, editions, certificates
- Collector: manage collection, provenance
- Curator/Expert: create collections, issue expert opinions

Organizational Accounts:
- Gallery/Institution: manage author portfolios, exhibitions
- Auction House: conduct auctions, issue certificates

3. SERVICES DESCRIPTION

Core services include:
- Artwork catalog management
- Certificates of Authenticity generation
- Edition and instance management
- Public/private galleries
- Provenance tracking tools
- API access on paid plans

Free personal account limits:
- Up to 50 artworks
- 1 edition per artwork
- 10 certificates (lifetime)
- 1 GB storage

4. REGISTRATION & ACCOUNT MANAGEMENT

- Provide accurate information
- Unique email per account
- Secure password (min 8 chars)
- Organizations must provide proof of legal status upon request

Verification may be required for:
- Galleries/institutions
- High-volume authors (KYC)
- Suspected fraudulent activity

5. INTELLECTUAL PROPERTY

- You retain rights to uploaded content
- You warrant having rights to all content
- You grant the Platform necessary technical rights for storage, processing, display within the service
- We do not license/sell your artworks or use them in advertising without consent

6. CERTIFICATES OF AUTHENTICITY

- Reflect data snapshot at issuance time
- Cannot be deleted or modified
- Blockchain anchoring is optional and irreversible

7. USAGE RULES AND MODERATION

Prohibited content:
- Counterfeit works
- Illegal/offensive material
- Third-party rights violations
- Malicious software

We may moderate, remove content, or suspend accounts for violations.

8. PRIVACY & DATA PROTECTION

- Governed by our Privacy Policy
- GDPR compliant
- Users may request data export, correction, or deletion (subject to legal limits)

9. API & INTEGRATIONS

- Available on paid plans
- Rate limits apply
- API keys are confidential

10. LIMITATION OF LIABILITY

- Service provided “as is”
- Maximum liability limited to amounts paid in last 12 months
- Not liable for lost profits or authenticity of other users' artworks

11. TERMINATION

- Users may delete accounts via settings
- Platform may suspend/delete accounts for violations or non-payment
- Public certificates remain in registry

12. DISPUTE RESOLUTION

- Mandatory pre-litigation claim (30 days)
- Governing law: [Jurisdiction]
- Venue: courts at Platform's registration location

13. FINAL PROVISIONS

- Entire agreement between parties
- Invalid provisions do not affect remainder
- Platform may assign rights to a successor
- Force majeure applies
